Debt recovery and Litigation Services
During the last decade we have recovered many millions of pounds for our recruitment clients making us one of the leaders in this sector. Injunctive Relief Advice and Representation
We regularly advise on the use of emergency Injunctions to restrain wrongful use of confidential company information (often client and candidates details) which has been removed without consent, often by former employees or directors. We often combine these applications with a claim with damages for the monetary losses suffered by our clients.
Restrictive Covenant Advice
We have extensive experience claims arising from alleged breaches of restrictive covenants by employees in their contracts of employment. The claims can range from claims for emergency Injunctive Relief, damages claims or negotiated settlement - as the individual circumstances of each case dictates. We act for both Claimants and Defendants.
Mediation Services and Alternative Dispute Resolution.
We are conscious of the commercial realities of protracted legal proceedings and will where appropriate recommend ADR to our clients. We do not believe in a “one size fits all” approach.
Insolvency & Restructuring Advice
We help Recruitment companies who find themselves in financial difficulties to understand the insolvency options available to them, including administration, liquidation and CVAs. Insolvency does not necessarily have to mean the end of a business and we assist clients in helping, if practical, to rescue their business as a going concern. FWJ has strong links with reputable insolvency practitioners and we can also refer clients to insolvency practitioners and restructuring experts if need be.
Post Insolvency Advice
We regularly assist companies whose suppliers and customers have been placed into administration by providing them with an explanation of the insolvency process and the impact it will have them. We often assist with the completion of proof of debt and proxy forms and can arrange for representation at creditors’ meetings.
We are also experienced at advising parties in respect of potential claims made against them by insolvency practitioners (e.g. in respect of repayment of loans, preference payments, transactions at undervalue etc) or in respect of requests for information made of them pursuant to s234, 236 etc of the Insolvency Act 1986.
Commercial Finance Advice
The Commercial Finance team can assist recruitment clients, be they directors, partnerships or sole traders on the terms of new business loans or renegotiating existing facilities and the related security documents necessary, including guarantor obligations. We frequently advise businesses about funding options available to them and assist them in understanding factoring and invoice discounting facilities.
In addition, FWJ advises on a wide range of general contract and commercial matters for both start up and existing businesses, including drafting shareholder and investor agreements, supply contracts, commercial services agreements and general terms and conditions, of which we have substantial experience.
