The ability to offer alternative forms of dispute resolution is an important key to any successful recovery. Indeed, the current attitude of the courts is to encourage parties, where possible, to try and resolve claims without recourse to formal litigation.

The new ethos is now encompassed in the provisions of the Practice Direction on Pre Action Conduct, which came in to force on 6th April 2009. Parties who fail to follow these new rules and simply issue legal proceedings risk a range of sanctions including costs penalties and having the entire claim stayed whilst the ADR process is conducted.
