This edition of the FWJ INFORMER looks at two of the hot topics for administrators that have developed in the course of 2011: how to ensure administrators have been validly appointed by directors of a company using the out of court route where there is no qualifying floating charge holder and whether the employee protections contained in TUPE 2006 are available to the employees of companies in administration. Insolvency law is facing a lot of change in the coming year, and we summarise some of the anticipated changes. We also look at the possible benefits to ABL’s and their customers from a proposed extension of the law on late payments and, once again, some recent examples of the recurring problems that prevent effective recoveries under guarantees and indemnities.
