Matthew Howat
Senior Associate
Directors Disqualification Solicitor
In addition to a broad commercial litigation practice, Mat has considerable experience advising directors in respect of proposed disqualification proceedings by the Insolvency Service. Mat has a sound background in advising director clients as to the likelihood of successfully resisting proceedings and, where appropriate, of how best to mitigate the legal and commercial consequences of disqualification. In the circumstances, Mat is experienced in seeking and negotiating minimal Disqualification Undertakings in order to avoid potentially merited disqualification proceedings.
Detailed examples of Mat’s background can be provided on request, however, his recent experience includes:
- Successfully represented the CEO of a technology company in respect of threatened Insolvency Service proceedings following the administration of a group of companies with just under £2m of Crown debt. Following detailed submissions to the Insolvency Service regarding the circumstances leading up to the administration, the background to the Crown debt accruals and the client’s involvement in the same, the client was released from all further proceedings, without sanction or Undertaking.
- Successfully represented 7 directors of a group of companies in forcing the Insolvency Service to drop threatened disqualification proceedings, without sanction.
Mat’s broad commercial background and specialist knowledge in the field of director disqualification ensures an accurate appraisal of proposed disqualification proceedings and their pragmatic disposal, with or without Court involvement.
