Why the client needed our help

Our client, a successful property developer, had encountered difficulties on a project which led to the liquidation of the company. An issue had arisen with the main contractor during the project and the liquidator had obtained a freezing order against our client in respect of director payments he said should not have been made from the company prior to the liquidation.

How we helped

We dealt firstly with the freezing order, agreeing terms as to the monetary limits and then agreeing undertakings on behalf of our client so that he could continue in business while the problem was resolved.

We then dealt with the complex underlying claim which involved construction contracts and the liability or otherwise of the main contractor on site.  Detailed witness statement evidence was prepared in defence of the claim. This then meant that we could deal with the matter in a full day mediation – at which a suitable settlement was reached.

We worked closely with counsel and building surveyors as part of this case.

The outcome

A settlement was reached at mediation. This was highly important to our client as it freed him up to complete some other significant property development work, He has since gone to become a very successful property developer.
