Why the client needed our help

We were instructed on behalf of an insolvency practitioner (an administrator), who instructed us to carry out a review of a potential matter. The objective was to determine if there were potential claims that could be initiated by the administrator against the directors of the company in administration.

How we helped

We conducted a detailed review of the case. During this process, we identified potential claims that could be brought against the directors. However, we also found substantial gaps in the evidence required to support these claims and ensure their success. Our analysis indicated that the available evidence was insufficient to substantiate the claims effectively and result in a recovery for the administrators.

The outcome

Our conclusion was that pursuing the claims would not yield substantial benefits for the administrators. The administrators were pleased to receive our written advice, as it demonstrated that they had complied with their statutory duties. Additionally, they acknowledged and accepted our expertise in the matter, appreciating the thoroughness and clarity of our review.
