Our client sought our assistance with recovering funds from a scheme, he and his company had invested in, to the sum of approximately £200,000.
How we helped
Upon being instructed, we reviewed the matter and advised our client on the action that could be taken.
- We prepared and sent a letter before action to the company operating the scheme, seeking repayment of our client’s monies, alongside a without prejudice offer letter to settle the matter at this stage.
- We also sought and obtained an asset trace report on the director of the company.
No response was received to the correspondence however our client received notice that the company was planning to enter into creditors voluntary liquidation. We got involved with this process and assisted our client with proposing an independent insolvency practitioner that was aware of the background and would ensure the company’s dealings were properly investigated.
The Outcome
The company was placed into liquidation and our client’s proposed liquidator was appointed. Despite our client not recovering his funds outside of a liquidation process, a liquidator has been appointed who is properly investigating the affairs of the Company and pursuing claims against those who received Company money.
Our client was happy with the result, as it meant a diligent insolvency practitioner had been appointed who would properly investigate the company’s dealings and consider pursuing claims that would increase the return for him as a creditor, alongside all other creditors.
