Why the client needed our help

The director of a thriving accountancy firm came to us facing disqualification proceedings in relation to his management of several other companies. He wanted us to help him find a way to continue acting as a director of the accountancy firm after disqualification.

How we helped

Through a successful application for court permission to remain acting as a director under Section 17 of the Company Directors Disqualification Act we succeeded in achieving his objective: Our detailed, carefully drafted and timely application was followed by a formal hearing where we demonstrated to the court that it was appropriate – and not against public interest – for permission to be granted.

The outcome

We successfully obtained court permission for our client to remain a director for the entire three years of our client’s disqualification period which meant that he was able to continue acting as a director of the accountancy firm for the duration.

The firm continued to flourish, with him at the helm.

I was greatly impressed with the commercial, tactical and technical ability of the team at FWJ. They quickly got to grips with a complex set of facts and, through their hard work, had the proceedings against me dropped and a significant proportion of my legal fees repaid. I couldn’t recommend them highly enough.
