Why the client needed our help
We were instructed on behalf of an insolvency practitioner in connection with a company in liquidation. The client sought advice on identifying potential claims in the liquidation and assessing the merits of pursuing those claims.
How we helped
We conducted a detailed review of the case. During this process, we identified that there were viable claims against the director of the company in liquidation for unlawful dividends, misfeasance and wrongful trading but that the prospects of the client making a recovery for the benefit of the creditors was low.
The outcome
Our conclusion was that pursuing the claims would not yield substantial benefits for the client. The client was pleased to receive our written advice, as it demonstrated that they had complied with their statutory duties. Additionally, they acknowledged and accepted our expertise in the matter, appreciating the thoroughness and clarity of our review.
