Why our client needed our help
Our client approached us just a week before his trial, where he faced charges of fraudulent trading and potential liabilities totalling £1.4m owed to creditors. His previous solicitors had withdrawn from the court record, and we were instructed to quickly file an application to adjourn the trial and allow time to submit additional evidence in his defence. Unfortunately, due to the late timing of the client, the application was refused and judgment given against the client, leading us to revise our strategy to better support and advise the client under these circumstances.
How we helped
After the client was found guilty at trial and ordered to pay the creditors, we helped him apply for an extension of time to settle the debt. Although the court denied this application, it provided us essential time to prepare for and file an application for permission to appeal against the trial decision as instructed by the client. We formally entered onto the court record, secured an extension to file for permission to appeal, and submitted the necessary documents for the court to review.
The outcome
Although the application for permission was denied, our the client was given the opportunity to request a reconsideration of the application at an oral hearing. This subsequent hearing took place, and the judge reviewed and listened to all arguments presented by counsel, but ultimately decided against granting permission. Although the legal proceedings did not yield a favourable verdict, they did allow the client time to manage his affairs and remain living in his primary residence for an extended period. This was one of his main objectives as he sought to postpone enforcement actions.
