Why the client needed our help

Our clients, three directors of a construction firm, were facing disqualification proceedings in connection with the liquidation of a company they had previously directed.

The trio was accused of withdrawing large sums of money from the company’s funds before it became insolvent. Disqualification would, among other consequences, prevent them from directing their new company which would then have to cease trading.

How we helped

We dealt with all litigation aspects of the disqualification proceedings, providing strategic advice on how to handle the offer of an undertaking and defending our clients through to trial.

The outcome

The disqualification claim was dismissed at trial and our clients recovered almost all of their legal costs. All three were able to successfully continue directing their new business and get on with their lives.
