A director we defended against a disqualification claim
If the Public Interest Unit feels there is sufficient evidence to bring director disqualification proceedings against a director of the company which has been wound up in the public interest, it will request the Secretary of State commences proceedings against that director.
- directors can be disqualified for a number of reasons (please visit our other web pages)
- director disqualification orders can be from anywhere between 2 year to 15 years in the most serious of cases.
If the director disqualification is as a result of a company being wound up in the public interest, it is not uncommon for former directors of those companies to be given longer periods of director disqualification. This is because the courts often feel that their actions have caused harm to the public interest as a whole and that that director should not be allowed to be a director for a substantial period of time.
