Careful planning and preparation is essential for anyone thinking of obtaining a Search order
Careful planning and preparation essential
Executing the search order is central to a successful outcome and is one that needs careful planning and consideration.
Not only do the procedural requirements need to be adhered to but it is very useful to have an understanding of certain practical matters such as:
- where the respondent’s premises are located;
- the best entry and exit routes;
- their usual opening hours, especially at weekends; and
- that the solicitor’s team is sufficient in numbers to properly search the respondent’s premises, especially if there is more than one office. If the premises are in different locations, then there should ideally be distinct and separate legal teams available to visit those premises at the same time to avoid the respondent tipping off other personnel who might be located else where in the country.
