We are delighted to have secured a successful outcome for Mr Victor Restis including the dismissal of Ms Staveley’s application to set aside the Statutory Demand served upon her.
Francis Wilks & Jones welcome successful decision for Victor Restis in his claim against the co-owner of Newcastle United FC, Amanda Staveley and her company, PCP Capital Partners (now known as Apollo Belvedere Services LLP)
Ms Staveley had sought the protection of the court to avoid being made bankrupt and to avoid her company, Apollo Belvedere Services LLP (previously known as PCP Capital), being put into liquidation. Ms Staveley owes a significant amount of money to our client.
- In her application and at court, she made a number of accusations against Mr Restis and his Solicitor Mr John Neocleous that were found to be totally untrue.
- In the words of the High Court Judge, they were “wholly without merit” and “used as a screen to avoid payment”.
- The Court further noted that the claim that she did not understand she was personally liable “ventures into the realm of fantasy”.
- Consequently, the Judge completely rejected her lawyer’s submissions made against Mr Restis and Mr Neocleous effectively deciding that the long outstanding debt of 16 years must be paid by Ms Staveley if she is to avoid bankruptcy.
The debt has been due from Ms Staveley since 2008 and this decision means that unless Ms Staveley or PCP Capital Partners LLP now known as Apollo Belvedere Services LLP pay the debt of at least £3.4m by the deadline of April 22nd 2024, Ms Staveley will face bankruptcy and Apollo Belvedere Services LLP as it is now known after the name change made after the statutory demand for payment was made to Ms Staveley, will be wound up by the court.
In addition, Mr Restis has other financial claims against Ms Staveley for significant interest and legal costs which he will also be pursuing promptly.
