I am a solicitor in the Dispute Resolution team at Francis Wilks & Jones, specialising in contentious insolvency. I act for individuals, company directors and shareholders, as well as insolvency practitioners, in a wide range of disputes arising out of financial distress, company failure and allegations of misconduct.
I regularly represent clients in High Court litigation across England and Wales and have experience acting in cross-border matters. My recent work includes representing clients before both the First Instance and Appellate Courts of the Qatar International Court, giving me insight into disputes with an international dimension.
My expertise includes:
- Bringing and defending claims under the Insolvency Act 1986 and the Companies Act 2006.
- Acting for directors and shareholders of SMEs involved in boardroom and governance disputes.
- Recovering funds for liquidators and administrators into insolvent estates.
- Advising on alternative dispute resolution, including mediation, to achieve commercial settlements and avoid unnecessary trial costs.
Examples of my experience include:
- Acting for defendants in a £20m claim brought under section 423 of the Insolvency Act 1986 by a UAE-based bank.
- Successfully applying to annul a bankruptcy order where the bankrupt had not responded to the statutory demand or bankruptcy petition.
- Settling a dispute between three shareholders in a surveying firm at mediation, avoiding trial and associated cost risks.
- Bringing successful proceedings against a director and shadow director under section 212 of the Insolvency Act 1986.
Dan Tominey at FWJ was able to navigate me through the legal arguments and process with his sound advice. Dan’s reassurance, calm approach and good humour was maintained throughout. I would recommend Dan and FWJ to anyone looking for valuable corporate advice.
