I have over 10 years’ experience advising on all aspects of turnaround, restructuring and insolvency matters, including administrations, liquidations, company voluntary arrangements, personal voluntary arrangements and bankruptcies.

  • banks and financial institutions, advising them on the best course of action to ensure the recovery of debts from insolvent companies
  • SMEs, directors and shareholders whose businesses are suffering financial difficulty and need help finding the best way through their situations. This can mean turning things around or simply achieving the greatest possible return from a restructuring or an insolvency procedure
  • private clients struggling with debt and facing claims by creditors and insolvency practitioners
  • insolvency practitioners in relation to the full spectrum of contentious and non-contentious insolvency matters
  • other parties involved in restructuring and insolvency procedures, including debtors, creditors/creditor groups, employees and third parties

My highlights include:

  • assisting troubled businesses and their directors across a broad range of industries, helping them with restructuring and turnaround or advising on the most appropriate insolvency procedure
  • acting in the sale of an import and export garden business for a purchaser of the business and assets of a company in administration
  • successfully assisting the administrators of a multi-million pound property investment company with multiple subsidiaries with obtaining an urgent order from the court allowing the administrators to remove and replace the director of the subsidiaries without the need to follow the formal requirements of the Companies Act 2006
  • assisting the trustees in several bankruptcies realise multiple properties previously owned by a bankrupt after obtaining orders for possession and sale
  • acting for the administrators of a Netherlands incorporated company whose sole asset was a property located in London to successfully obtain the withdrawal of a claim made by a creditor of the company challenging the conduct of and seeking the removal of the administrators, which resulted in the subsequent sale of the property £48 million
  • assisting administrators with obtaining the validation of their appointment by the court despite the presentation of two separate winding up petitions prior to their appointment ensuring that all acts of the administrators since appointment were valid
  • assisting creditors with obtaining an administration order against a multi-million pound property investment company which was defended by the company and which a winding up petition was previously presented against
  • acting in the sale of a group of business centres offering shared work spaces as a going concern by administrators which involved multiple properties and safeguarded numerous jobs as well as payments to landlords
  • assisting the administrators of a company which carried on the business of a collection account management agent in the film and media industry for royalties provided in Sterling, US Dollars, Euros and Australian Dollars with obtaining multiple Berkeley Applegate orders ensuring that the administrators had a right to payment of remuneration and reimbursement of costs and disbursements out of the funds held on trust by the company
  • successfully assisting the liquidators and a shareholder of a multi-million dollar parent company placed into liquidation with obtaining the rescission of a winding up order
  • assisting with preference, undervalue, misfeasance, wrongful and fraudulent trading claims on behalf of insolvency practitioners which included negotiating settlement prior to issuing proceedings
  • assisting high net worth individuals with obtaining the annulment of bankruptcy orders following refinancing of properties
  • assisting various individuals and companies with defending bankruptcy and winding up petitions and helping them enter alternative, more appropriate insolvency procedures
