Our specialist team has extensive experience assisting individuals with their personal liabilities as well as liabilities arising from a business such as sole traders and partners. We understand that each individual’s circumstances are different and as such, we work with individuals to take the most appropriate action depending on their circumstances.

Bankruptcy petitions and annulments

We regularly provide assistance to individuals facing bankruptcy proceedings, providing guidance on all claims brought by trustees in bankruptcy which include claims against the matrimonial home, income payment orders, and claims challenging transactions entered into by an individual before the Bankruptcy order was made.

Statutory demand defence

If you are served with a Statutory Demand and you dispute the debt then you only have 18 days to do that.  A Statutory Demand must be taken seriously and with the right help in place the outcome could be not only avoiding a bankruptcy but a resolution of a dispute at an early stage.

Bankruptcy petition defence

The defence of a bankruptcy petition can be difficult and stressful.  There are always time pressures with court hearings coming up but we have wide experience in strategy in bankruptcy proceedings and defending claims.

Settlement of debts to avoid bankruptcy

Even where you cannot dispute the claim, bankruptcy may not be good for the creditor either and negotiations often succeed in finding a resolution which is more favourable to everyone.

Obtaining the dismissal of a bankruptcy petition to remortgage

If you are in the middle of a remortgage to try to pay a debt, your solicitor dealing with your remortgage may have told you that the remortgage cannot complete because there is a registration in bankruptcy marked against your property.  Maybe HMRC may have told you that you need a validation order because they have gone ahead with a bankruptcy petition.  We can help and there are solutions to this problem.

Protecting your family home in bankruptcy

For many this is the most important aspect of bankruptcy but it doesn’t have to mean that you lose your home.  Sometimes there are other options available and at Francis Wilks & Jones we have comprehensive experience negotiating and protecting the family home in bankruptcy.

Removing / annulling your bankruptcy

It may be that your bankruptcy was a mistake or that, for some reason, circumstances have changed since your bankruptcy and you are now able to extricate yourself from it by applying for an annulment.  Examples would be payment in full following a windfall, an inheritance, property values increasing or perhaps you have recently been made bankrupt by error or proper process has not been met.

Effects of bankruptcy

Bankruptcy is a very personal thing and it effects different people in different ways.  Sometimes the effects are not noticed for some but for others have a significant impact on their family and business lives.  Whether it be in anticipation of bankruptcy or needing to understand what is happening during your bankruptcy our team at Francis Wilks & Jones can advise.

Defending claims by a Trustee in Bankruptcy or Official Receiver

Your bankruptcy will be run either by a Trustee in Bankruptcy or the Official Receiver.  We can explain the difference but either way claims against people connected to you or against you as the bankrupt are common in bankruptcy situations.  At Francis Wilks & Jones we are experienced in defending those claims and provide advice and strategy in dealing with them.

Effect of bankruptcy on foreign property

It is very common these days for there to be holiday homes or family residences outside of the UK which are caught up in bankruptcy.  We can advise and assist around how you can expect property abroad will be dealt with, whether it can be protected in bankruptcy or sometimes saved.

Individual voluntary arrangements

If you need assistance with individual voluntary arrangements, our expert team can help. Alternatively, we have brilliant contacts in the industry who might also be able to assist.
