Enforcement of Possession
1. Warrant of possession
If the tenant(s) still refuse to vacate the property by this date, a landlord will then need to apply to the court for a Warrant of Possession.
This is an application to court to instruct the court bailiffs to evict the tenant(s).
A possession order will normally specify the date on which the tenant (s) have to give up possession of the property. This is normally 14 to 28 days after the date of the possession order, but can be shorter.
2. How long does it take for bailiffs to evict tenants?
We are often asked by clients “how long does it take for bailiffs to evict tenants?
If a tenant or tenants refuse to leave their property after being served with a possession order, it is usual for the landlord to instruct a county court bailiff to evict them.
In such an instance, the bailiff will send a Notice of Eviction to the property address (usually addressed to the tenants personally) which will give details of when the bailiffs will be attending the property to evict them.
