The Firm has three principal teams designed to assist an ABL’s every need. The close interaction between these teams means that a client problem can be dealt with swiftly and effectively.
Headed by Andy Wilks our Litigation team covers all aspects of litigation requirements in the ABL industry. These range from all manner of customer and guarantor claims to complex fraud and injunctive work.
The team is also supported by a bespoke case management system, the content of which was designed by Andy Wilks specifically to deal with the requirements of the ABL industry. It enables instructions to be sent electronically from our clients’ software systems directly in to our CMS system, whether on a single instruction basis or a full collect out. Not only does it hugely speed up the recoveries process, it also enables us to provide our clients with highly refined reports on all live and closed matters at a touch of a button – something unique amongst providers of legal services to the ABL market.
Insolvency & Business Recovery
Headed by Tim Francis the team have built a strong reputation as an extremely safe pair of hands in any insolvency situation where book debts and other encumbered assets are at risk within the ABL industry.
We always work closely with IP’s to minimise an ABL’s exposure to costs by looking to the recoveries in the appointment for fees rather than to the appointing lender. The team is frequently requested by ABL’s to act for IP’s appointed by them and due to our reputation in the industry, we often “come with the appointment”. In most cases we will work closely with IP’s insofar as risk is concerned.
The Business Law team is run by Sally Bradshaw. The Business Law team specialises in drafting, and advising on, financiers’ standard ABL documentation, the related security and any ancillary documentation such as waivers, postponements and releases for the take on of a new prospect. Where a prospect is a sole trader or partnership, we offer a specialist Bills of sale registration service to provide an ABL with the optimum security position in respect of such a business.
We also advise ABL’s on the various issues that can crop up in the day to day management of on-going facilities.
Additionally, we can conduct a review of a prospect’s contracts and terms and conditions and advise ABL’s on whether particular debts are suitable for assignment and carry out security reviews for ABL’s in connection with the enforcement of their security.
